Patrick dela Rosa has denied the rape charge

Actor-turned-politician Patrick dela Rosa has denied the rape charge filed against him by a 20-year-old student.

According to a report in GMA-7's 24 Oras aired last night, October 19, Dela Rosa sent a letter to Oriental Mindoro Gov. Alfonso "Boy" Umali detailing his denial of the charges.

Dela Rosa has recently been transferred to Quezon City Jail from the detention cell of Quezon Police District Station 7. He had declined from talking to the press on both locations, so the letter is the first statement that he has released to the public after he was arrested on October 11.

In the letter, dela Rosa said the charges against him are not based on truth.

"I deny the accusation hurled against me and I am prepared to present my witnesses and the pieces of evidence," says Dela Rosa.

Dela Rosa wrote the letter to file his leave of absence from his duties as a board member of Oriental Mindoro.

THE COMPLAINANT'S STORY. The reported attempted rape incident allegedly happened at Unit 2206, Regalia Towers, P. Tuazon corner Edsa, Cubao, Quezon City, on October 8, Friday, at about 2 a.m.

According to the complainant's affidavit, she and her friends were having a drinking session when Dela Rosa arrived. She then went to her room and slept easily due to alcohol intake.

The complainant said she woke up at 5 a.m and found herself naked. Dela Rosa, she said, was already on top of her. She said her screams woke up her friends, who came to help her.

In the complainant's interview with Startalk on October 16, she said she will pursue Dela Rosa's incarceration.

THE WITNESSES. 24 Oras interviewed the witnesses present at the drinking session. They told 24 Oras that no rape incident happened.

"Oo, inamin niya na wala naman pong nangyari saka hindi naman talaga siya nagahasa. Yung act na ginawa, wala daw," an unidentified female witness said.

They also told the news program that they asked the complainant to avoid talking to the press. But after she gave her statement, they felt they should also give their own side.

"Bilang babae rin, mas kakampihan mo yung alam mong yung akala mong naagrabyado... Nung nandun na kami sa presinto, dun na lang po niya sinabi [na walang rape na naganap]," said another witness who refused to face the camera.

24 Oras tried to get the complainant's reactions on the witnesses' statements through her lawyer Atty. Freddie Villamor.

Villamor sent the following message: "According to the victim, she fully cooperated with the police without any hesitation. And she stands pat on what she said in her affidavit complaint."
